1) Scope of Application

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of the company Dennis Zaiser (hereinafter referred to as "Seller”) shall apply to all contracts concluded between a consumer or a trader (hereinafter referred to as "Client”) and the Seller relating to all goods and/or services presented in the Seller's online shop. The inclusion of the Client’s own conditions is herewith objected to, unless other terms have been stipulated.

1.2 These GTC apply accordingly to the supply of digital content, unless expressly agreed otherwise.

1.3 Regarding the purchase of vouchers, these GTC shall apply accordingly, unless expressly agreed otherwise.

1.4 For contracts regarding the delivery of vouchers, these GTC shall apply accordingly, unless expressly agreed otherwise.

1.5 A consumer pursuant to these GTC is any natural person concluding a legal transaction for a purpose attributed neither to a mainly commercial nor a self-employed occupational activity. A trader pursuant to these GTC is any natural or legal person or partnership with legal capacity acting in the performance of a commercial or self-employed occupational activity when concluding a legal transaction.

1.6 Digital content in the sense of these GTC is all data not on a tangible medium which are produced in digital form and are supplied by the Seller by granting certain usage rights precisely defined in these GTC.

2) Conclusion of the Contract

2.1 The product descriptions in the Seller’s online shop do not constitute binding offers on the part of the Seller, but merely serve the purpose of submitting a binding offer by the Client.

2.2 The Client may submit the offer via the online order form integrated into the Seller's online shop. In doing so, after having placed the selected goods and/or services in the virtual basket and passed through the ordering process, and by clicking the button finalizing the order process, the Client submits a legally binding offer of contract with regard to the goods and/or services contained in the shopping cart.

2.3 The Seller may accept the Client’s offer within five days,

  • by transferring a written order confirmation or an order confirmation in written form (fax or e-mail); insofar receipt of order confirmation by the Client is decisive, or
  • by delivering ordered goods to the Client; insofar receipt of goods by the Client is decisive, or
  • by requesting the Client to pay after he placed his order.

Provided that several of the aforementioned alternatives apply, the contract shall be concluded at the time when one of the aforementioned alternatives firstly occurs. Should the Seller not accept the Client’s offer within the aforementioned period of time, this shall be deemed as rejecting the offer with the effect that the Client is no longer bound by his statement of intent.

2.4 If the Client chooses "PayPal Express” when placing his order, payment processing is handled by the payment service provider PayPal (Europe) S.a.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter referred to as “PayPal”). The PayPal terms of use shall apply which can be viewed at: https://www.paypal.com/ie/webapps/mpp/ua/servicedescription-full?locale.x=en_IE.

In case the Client has no PayPal account, the conditions for payments without PayPal account will apply which can be viewed at: https://www.paypal.com/ie/webapps/mpp/ua/legalhub-full?locale.x=en_US.

If the Client chooses “PayPal Express” as payment method, he initiates also a payment order to PayPal by clicking the button finalizing the order process. In this case, the Seller declares his acceptance of the Client’s offer already at the time when the Client initiates the payment transaction by clicking the button finalizing the ordering process.

2.5 If the Client chooses the payment method “Amazon Payments”, payments are processed by the payment service provider Amazon Payments Europe S.C.A., 38 avenue John F. Kennedy, L-1855 Luxembourg (hereinafter referred to as „Amazon“).

If the Client chooses “Amazon Payments” as payment method during the online ordering process, he, at the same time, makes a payment order to Amazon when initiating the payment transaction by clicking the button finalizing the ordering process. In this case, the Seller declares his acceptance of the Client’s offer at the time when the Client initiates the payment transaction by clicking the button finalizing the ordering process.

2.6 When submitting an offer via the Seller's online order form, the text of the contract is stored by the Seller after the contract has been concluded and transmitted to the Client in text form (e.g. e-mail, fax or letter) after the order has been sent. The Seller shall not make the contract text accessible beyond this. If the Client has set up a user account in the Seller's online shop prior to sending his order, the order data shall be stored on the Seller's website and can be accessed by the Client free of charge via his password-protected user account by specifying the corresponding login data.

2.7 Prior to submitting a binding order via the Seller’s online order form, the Client may recognize input errors by reading attentively the information displayed on the screen. The enlargement function of the browser to enlarge the display on the screen may be an effective method for better recognizing input errors.
The Client can correct all the data entered via the usual keyboard and mouse function during the electronic ordering process, until he clicks the button finalizing the ordering process.

2.8 The German and the English language are exclusively available for the conclusion of the contract.

2.9 Order processing and contacting usually takes place via e-mail and automated order processing. It is the Client’s responsibility to ensure that the e-mail address he provides for the order processing is accurate so that e-mails sent by the Seller can be received at this address. In particular, it is the Client`s responsibility, if SPAM filters are used, to ensure that all e-mails sent by the Seller or by third parties commissioned by the Seller with the order processing can be delivered.

3) Right to Cancel

3.1 Consumers are entitled to the right to cancel.

3.2 Detailed information about the right to cancel are provided in the Seller’s instruction on cancellation.

3.3 The right to cancel does not apply to consumers, who are no nationals of a member state of the European Union at the time of concluding the contract und whose exclusive domicile and delivery address were located outside of the European Union at the time of concluding the contract.

4) Prices and Payment Conditions

4.1 Unless otherwise stated in the Seller’s product description, prices indicated are total prices including the statutory sales tax. Delivery costs, where appropriate, will be indicated separately in the respective product description

4.2 Payment can be made using one of the methods mentioned in the Seller’s online shop.

4.3 In case of delivery to countries outside the European Union, additional costs may incur in individual cases for which the Seller is not responsible and which have to be borne by the Client. This includes for example transfer fees charged by banking institutes (transfer charges, exchange fees) or import duties or taxes (customs). Such costs regarding money transfer may also incur, if delivery is not made in a country outside the European Union and the Client carries out the payment from a country outside the European Union.

4.4 If the payment method "PayPal invoice" is selected, the Seller assigns his payment claim to PayPal. Before accepting the Seller's declaration of assignment, PayPal carries out a credit check using the transmitted Client data. The Seller reserves the right to refuse the Client the payment method "PayPal invoice" in case of a negative credit check. If the payment method "PayPal Invoice" is accepted by PayPal, the Client must pay the invoice amount to PayPal within 30 days from receipt of the goods, unless PayPal specifies a different payment term. In this case, he can only make payments with debt-discharging effect only to PayPal. However, in the event of assignment of claims, the Seller shall remain responsible for general customer inquiries, e. g. regarding the goods, delivery time, dispatch, returns, complaints, cancellation declarations and dispatches or credit notes. In addition, the General Terms and Conditions of Use for the use of the payment method “purchase” on account with PayPal shall apply; these conditions can be viewed at https://www.paypal.com/de/webapps/mpp/ua/pui-terms.

4.5 If the payment method "PayPal direct debit" is selected, PayPal collects the invoice amount from the customer's bank account on behalf of the Seller after a SEPA direct debit mandate has been issued, but not before the deadline for pre-notification has expired. Pre-notification means any communication (e. g. invoice, policy, contract) to the Client announcing a debit via SEPA direct debit. If the direct debit is not honored due to insufficient account coverage or due to the indication of an incorrect bank account, or if the Client objects to the debit, even though he is not entitled to do so, the Client shall bear the fees arising from the reversal of the respective bank, if he is responsible for this.

4.6 When payments are made using a payment method offered by PayPal, handling of payments takes place via the payment service provider PayPal ((Europe) S.a. r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter called “PayPal”) subject to the PayPal terms of use which can be viewed at: https://www.paypal.com/de/webapps/mpp/ua/useragreement-full.

In case the client has no PayPal account, the conditions applicable for payments without PayPal account will be effective. They can be viewed at: https://www.paypal.com/de/webapps/mpp/ua/privacywax-full

4.7 If the payment method "immediate bank transfer" is selected, payment processing is carried out via the payment service provider SOFORT GmbH, Theresienhöhe 12,80339 Munich (hereinafter referred to as "IMMEDIATE"). If he wants to be able to pay the invoice amount via “immediate bank transfer,” the Client must have an online banking account that is activated for participation in “immediate bank transfer”. Furthermore he must have the appropriate credentials during the payment process, and must confirm the payment instruction to IMMEDIATE . The payment transaction will be executed immediately afterwards and the Client’s bank account debited accordingly. 5) Shipment and Delivery Conditions

5.1 Goods are generally delivered on dispatch route and to the delivery address indicated by the Client, unless agreed otherwise. During the processing of the transaction, the delivery address indicated in the Seller’s order processing is decisive.

5.2 Should the assigned transport company return the goods to the Seller, because delivery to the Client was not possible, the Client bears the costs for the unsuccessful dispatch. This shall not apply, if the Client exercises his right to cancel effectively, if the delivery cannot be made due to circumstances beyond the Client's control or if he has been temporarily impeded to receive the offered service, unless the Seller has notified the Client about the service for a reasonable time in advance.

5.3 Personal collection is not possible for logistical reasons.

6) Granting Rights of Use for Digital Content

6.1 Unless otherwise stipulated in the description of contents displayed in the Seller's online shop, the Seller grants the client the non- exclusive right, unlimited in relation to place and time, to use the contents supplied exclusively for private purposes.

6.2 The transmission of content to third parties or the production of copies to third parties in a way not covered by the GTC is prohibited, unless the Seller has consented to the transfer of the contractual license to third parties.

6.3 The granting of rights pursuant to section 158 (1) German Civil Law Code will only become effective, if the Client has paid the contractually stipulated compensation in full. The Seller may allow the use of the contractual contents temporarily prior to this date. A transfer of rights does not take place via such a provisional permission.

7) Reservation of Proprietary Rights

If the Seller provides advance deliveries, he retains title of ownership to the delivered goods, until the purchase price owed has been paid in full.

8) Warranty

8.1 Should the object of purchase be deficient, statutory provisions shall apply.

8.2 The Client is asked to notify any obvious transport damages to the forwarding agent and to inform the Seller accordingly. Should the Client fail to comply therewith, this shall not affect his statutory or contractual claims for defects.

9) Special Conditions for the Processing of Goods According to Client's Specification

9.1 If, according to the terms of the contract, the Seller owes the delivery of the goods as well as the processing of the goods according to certain specifications of the Client, the Client shall make available to the operator all contents required for processing such as texts, images or graphics in the file formats, formatting, image and file sizes specified by the operator and shall grant the operator the necessary rights of use. The Client is solely responsible for the procurement and acquisition of rights for such content. The Client declares and assumes responsibility that he has the right to use the content provided to the Seller. In particular, he shall ensure that no third-party rights are infringed thereby, in particular copyrights, trademark rights and personal rights.

9.2 The Client shall indemnify the Seller from claims of third parties asserted against the Seller in connection with a violation of their rights by the Seller’s contractual use of the Client’s content. The Client shall also bear the reasonable costs required for the necessary legal defense, including all court and lawyer's fees according to the statutory rate. This shall not apply if the Client is not responsible for the infringement. In the event of claims by third parties, the Client shall be obliged to provide the Seller promptly, truthfully, and completely with all information that is necessary for the verification of the claims asserted for a corresponding defense.

9.3 The Seller reserves the right to refuse processing orders, if the content provided by the Client for this purpose violates legal or official prohibitions or morality. This shall apply in particular to the provision of content that is anti-constitutional, racist, xenophobic, discriminatory, offensive, or youth-endangering, and/or if it glorifies violence.

10) Redemption of Campaign Vouchers

10.1 Vouchers which are issued by the Seller free of charge, for a specific period of validity in the context of promotional activities and which cannot be purchased by the Client (hereinafter referred to as "campaign vouchers”) can only be redeemed in the Seller’s online shop and only within the indicated time period.

10.2 Individual products may be excluded from the voucher campaign, if such a restriction results from the conditions of the campaign voucher.

10.3 Campaign vouchers can only be redeemed prior to the conclusion of the order procedure. Subsequent offsetting is not possible.

10.4 Only one campaign voucher can be redeemed per order.

10.5 The goods value should meet at least the amount of the campaign voucher. The Seller will not refund remaining assets.

10.6 If the value of the campaign voucher is not enough for the order, the Client may choose one of the remaining payment methods offered by the Seller to pay the difference.

10.7 The campaign voucher credit will not be redeemed in cash and is not subject to any interest.

10.8 The campaign voucher will not be redeemed, if the Client, in the context of his legal right to cancel, returns goods paid fully or partially by a campaign voucher.

10.9 The campaign voucher is transferable. The Seller may render performance with discharging effect to the respective owner who redeems the campaign voucher in the Seller’s online shop. This does not apply, if the Seller has knowledge or grossly negligent ignorance of the non-entitlement, legal incapacity or of the missing right of representation regarding the respective owner.

11) Redemption of Gift Vouchers

11.1 Vouchers which can be purchased via the Seller’s online shop (hereinafter referred to as "gift vouchers") can only be redeemed in the Seller’s online shop, unless otherwise stipulated in the voucher.

11.2 Gift vouchers and remaining assets of gift vouchers can be redeemed by the end of the third year following the year of the gift voucher purchase. Remaining assets will be credited to the Client’s voucher account.

11.3 Gift vouchers can only be redeemed prior to the conclusion of the order procedure. Subsequent offsetting is not possible.

11.4 Only one gift voucher can be redeemed per order.

11.5 Gift vouchers can only be used for the purchase of goods and not for the purchase of other gift vouchers.

11.6 If the value of the gift voucher is not enough for the order, the Client may choose one of the remaining payment methods offered by the Seller to pay the difference.

11.7 The gift voucher credit will not be redeemed in cash and is not subject to any interest.

11.8 The gift voucher is transferable. The Seller may render performance with discharging effect to the respective owner who redeems the gift voucher in the Seller’s online shop. This does not apply, if the Seller has knowledge or grossly negligent ignorance of the non-entitlement, legal incapacity or of the missing right of representation regarding the respective owner.

12) Applicable Law

12.1 The law of the Federal Republic of Germany shall apply to all legal relationships between the parties under exclusion of the laws governing the international purchase of movable goods. For consumers, this choice of law only applies to the extent that the granted protection is not withdrawn by mandatory provisions of the law of the country, in which the consumer has his habitual residence.

12.2 With regard to the statutory right of cancellation, this choice of law does not apply to consumers who do not belong to a member state of the European Union at the time of the conclusion of the contract and whose sole place of residence and delivery address are outside the European Union at the time of the conclusion of the contract.

12.3 Furthermore, this choice of law regarding the right to cancel does not apply to consumers, who are not nationals of a member state of the European Union at the time of concluding the contract and whose exclusive domicile and delivery address is located outside of the European Union at the time of concluding the contract.

13) Alternative dispute resolution

13.1 The EU Commission provides on its website the following link to the ODR platform: https://ec.europa.eu/consumers/odr.

This platform shall be a point of entry for out-of-court resolutions of disputes arising from online sales and service contracts concluded between consumers and traders.

13.2 The Seller is neither obliged nor prepared to attend a dispute settlement procedure before an alternative dispute resolution entity.

1) Ámbito de aplicación

1.1 Estas Condiciones Generales de Contratación de Dennis Zaiser (en lo sucesivo, «el vendedor») se aplican a todos los contratos celebrados entre un consumidor o empresario (en lo sucesivo, «el cliente») con el vendedor en relación con mercancías o prestaciones expuestas por el vendedor en su tienda online. Por la presente se excluyen las condiciones propias del cliente, a menos que se conviniera algo distinto.

1.2 A efectos de estas Condiciones generales de contratación, son consumidores o usuarios las personas físicas que actúen, sobre todo, con un propósito ajeno a su actividad comercial , empresarial o profesional independiente. Se considera empresario a toda persona física o jurídica, ya sea privada o a una sociedad personalista con o públicacapacidad jurídica, que, al celebrar un negocio jurídico, actúe directamente o a través de otra persona en su nombre o siguiendo sus instrucciones, con un propósito relacionado con su actividad comercial, empresarial o profesional independiente.

2) Celebración del contrato

2.1 Las descripciones de productos presentadas en la tienda web del vendedor constituyen ofertas vinculantes de este último, que el cliente acepta mediante un pedido.

2.2 El cliente puede realizar pedidos por teléfono, correo postal, fax o correo electrónico, o bien a través del formulario de pedidos en línea integrado en la tienda web del vendedor, aceptando así la oferta de este último. Al efectuar un pedido mediante el formulario en línea y después de haber introducido sus datos personales, el cliente emite su aceptación jurídicamente vinculante de la oferta contractual sobre los productos contenidos en su cesta de la compra haciendo clic en el botón de finalización del proceso de pedido.

2.3 En un plazo de 24 horas, el vendedor enviará al cliente una confirmación del pedido por correo postal o electrónico.

2.4 Con la aceptación de una oferta a través del formulario de pedido en línea del vendedor, este guardará el texto contractual y se lo enviará al cliente junto con las condiciones generales correspondientes en forma de texto (p. ej., por correo electrónico, fax o carta) después de que el cliente haya realizado el pedido. Asimismo, el texto contractual se archivará en el sitio web del vendedor y el cliente podrá consultarlo gratuitamente accediendo a su cuenta protegida con contraseña mediante sus datos de acceso, siempre que haya creado dicha cuenta en la tienda web del vendedor antes de realizar el pedido.

2.5 Antes de hacer su pedido vinculante a través del formulario en línea del vendedor, el cliente podrá corregir en cualquier momento sus datos mediante las funciones usuales del teclado y el ratón. Además, antes de hacer su pedido vinculante se le mostrarán todos los datos una vez más en una ventana de confirmación, y podrá corregirlos mediante las funciones usuales del teclado y el ratón.

2.6 La tramitación del pedido y la toma de contacto se llevan a cabo en general por correo electrónico y tramitación automática del pedido. El cliente deberá cerciorarse de que la dirección de correo electrónico que proporcione para la tramitación del pedido sea correcta, de modo que pueda recibir en esa dirección los correos electrónicos que el vendedor le envíe. En particular, en caso de utilizar filtros de correo no deseado, el cliente deberá asegurarse de que puedan recibirse todos los correos electrónicos que le envíe el propio vendedor o a través de un tercero autorizado por este para tramitar el pedido.

2.7 Si el cliente actúa en calidad de consumidor, el idioma de formalización del contrato solo podrá ser el español.

3) Precio y condiciones de pago

3.1 Los precios indicados por el vendedor son precios globales e incluyen el impuesto legal sobre el valor añadido. Cuando se apliquen costes de entrega o envío adicionales, se indicarán en la descripción del producto correspondiente por separado.

3.2 Cuando los envíos se efectúen a países fuera de la Unión Europea es posible que, en casos particulares, se generen otros costes que el vendedor no estará obligado a asumir y que correrán a cargo del cliente. Estos comprenden, entre otros, los costes de la transferencia de dinero a través de entidades de crédito (p. ej. comisiones de transferencias y por conversión de moneda) o tasas o impuestos de importación (p. ej. derechos de aduana).

3.3 El cliente dispone de diversas modalidades de pago ofrecidas a través de la página web del vendedor.

3.4 Si se conviene el pago por anticipado, este será exigible inmediatamente después de la celebración del contrato.

3.5 En caso de seleccionar la modalidad de pago «PayPal», el pago se tramitará a través del proveedor de servicios de pago PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxemburgo, de acuerdo con las Condiciones de uso de PayPal, que se pueden consultar en https://www.paypal.com/es/webapps/mpp/ua/useragreement-full?locale.x=es_ES .

4) Condiciones de entrega y envío

4.1 La entrega de la mercancía se efectúa regularmente mediante envío a la dirección de entrega indicada por el cliente. Para la tramitación de la transacción resultará determinante la dirección de entrega indicada en la tramitación del pedido del vendedor.

4.2 Cuando la empresa de transporte no pueda entregar la mercancía enviada al cliente y, en consecuencia, deba devolverla al vendedor, el cliente correrá con los gastos del envío infructuoso. Esto no será de aplicación, si el cliente ejerciera su derecho de desistimiento, si el cliente no fuera responsable de las circunstancias que hayan hecho imposible la entrega o cuando esté impedido de forma transitoria para recibir la prestación ofrecida, a menos que el vendedor le haya anunciado la prestación con un tiempo razonable de anticipación.

4.3 Si el cliente es un empresario, el riesgo de pérdida y deterioro fortuito de los productos vendidos es asumido por el cliente tan pronto como el vendedor haya entregado la mercadería a la empresa de transporte, el transportista o cualquier otra persona o empresa a quien se hubiera encomendado la realización del envío.

Si el cliente es un consumidor, el riesgo de pérdida y deterioro fortuito de los productos vendidos en principio no es asumido por el cliente o la persona autorizada para recibir la mercadería hasta el momento de la entrega de la misma. En cambio, si es el cliente quien encargó el envío a la empresa de transporte, el transportista o cualquier otra persona o empresa a quien se hubiera encomendado la realización del envío y el vendedor no hubiera mencionado dicha persona o empresa al cliente previamente, el riesgo de pérdida y deterioro fortuito de los productos vendidos también será asumido por el cliente, aun cuando sea consumidor, tan pronto como el vendedor haya entregado la mercadería a la empresa de transporte, el transportista o cualquier otra persona o empresa a quien se hubiera encomendado la realización del envío.

4.4 La recogida por parte del Cliente en el almacén del Vendedor no es posible .

5) Responsabilidad por defectos

5.1 En caso de que el producto comprado presente un defecto, se aplicarán las normas legales sobre responsabilidad por defectos y se indicarán los derechos jurídicos de garantía del consumidor conforme a la Ley General para la Defensa de los Consumidores y Usuarios. En virtud de esta ley, todos los productos del vendedor ofrecidos en su sitio web cuentan con una garantía legal de dos años.

5.2 En contraposición a lo anterior, lo siguiente se aplica a los bienes usados: las reclamaciones por defectos quedan excluidas si el defecto no se produce hasta un año después de la entrega de los bienes. Los defectos que se produzcan en el plazo de un año a partir de la entrega de los bienes pueden reclamarse dentro del plazo de prescripción legal. Sin embargo, la reducción del período de responsabilidad a un año no se aplicará

  • para los artículos que han sido utilizados para un edificio de acuerdo con su uso habitual y que han causado su deficiencia,
  • para las reclamaciones por daños y perjuicios y el reembolso de los gastos del cliente, y
  • en el caso de que el vendedor haya ocultado fraudulentamente el defecto.

5.3 Se pide al Cliente que reclame bienes entregados con evidentes daños de transporte al repartidor y que informe al Vendedor al respecto.
Si el Cliente no cumple con esto, no tiene ningún efecto sobre sus derechos de garantía por defectos legales o contractuales.

6) Derecho y jurisdicción aplicables

6.1 Todas las relaciones jurídicas entre las partes se regirán por las leyes del Reino de España, con exclusión de las leyes sobre la venta internacional de bienes muebles. En el caso de los consumidores, esta elección de ley sólo se aplica en la medida en que no se retire la protección otorgada por las disposiciones imperativas de la ley del Estado en el que el consumidor tiene su residencia habitual.

6.2 Además, esta elección de ley con respecto al derecho legal de desistimiento no se aplica a los consumidores que no pertenecen a un Estado miembro de la Unión Europea en el momento de la celebración del contrato y cuya única residencia y dirección de entrega se encuentran fuera de la Unión Europea en el momento de la celebración del contrato.

7) Resolución alternativa de litigios
