Terms of Use

1) Scope

These terms of use apply to the use of the Magical Night Sky website, operated by Wusana GmbH i. L. (see the imprint for full operator details). By using the website you accept these terms.

2) The service

Magical Night Sky lets you compose a poster of the night sky for a place and moment you choose, and download it as a JPG or PDF. The tool is provided free of charge and “as is”. The poster is generated and downloaded entirely in your browser; nothing is ordered, printed, shipped or sold through this website. We do our best to keep the service available and working, but we do not guarantee availability and may change or discontinue it at any time.

3) Your posters

The posters you create are yours to use — print them, gift them, hang them, for private or commercial purposes. Please do not resell the tool itself, pass the service off as your own, or present the generated files as a paid service of your own.

4) Your input and acceptable use

You are responsible for the text you place on a poster. Do not use the service unlawfully or to create content that is illegal or infringes the rights of others. Nothing you enter is reviewed, moderated or stored by us.

5) Intellectual property

The website, its software, the poster styles and the design are protected by law and remain the property of the operator or its licensors. Star-map data and the fonts used are used under their respective licences. The text and any content you add to a poster remain yours.

6) Warranty and liability

The service is provided without warranty of any kind to the extent permitted by law. In particular, the operator is not liable for print results — always check your downloaded file before ordering prints from a print shop.

The operator is liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence the operator is liable only where a material contractual obligation is breached, and then only for the foreseeable, typical damage. Any further liability is excluded.

7) Changes to these terms

We may update these terms as the service evolves. The version published here always applies to your use of the website.

8) Governing law and dispute resolution

These terms are governed by the law of the Federal Republic of Germany, to the extent this does not deprive a consumer of the protection of mandatory provisions of the law of their country of residence. The EU Commission provides a platform for online dispute resolution at https://ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
